Terms of Service

The rules of the road for using RAM Aggregator.

Please Read Carefully By accessing or using the RAM Aggregator network, website, chat application, provider software, or any related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

1. Overview

RAM Aggregator is an experimental, decentralized AI inference network that connects users who want to run large language model (LLM) inference with providers who contribute idle compute resources on Apple Silicon hardware. The Service is operated by the RAM Aggregator team ("we", "us", "our").

The Service includes the coordinator server, the web-based chat application, the macOS provider application, the xRAM ERC-20 token on Base mainnet, and all associated APIs, documentation, and tools.

2. Eligibility

You must be at least 18 years of age (or the age of legal majority in your jurisdiction) to use the Service. By using the Service, you represent and warrant that you meet this requirement and that you are not prohibited from using the Service under any applicable law.

3. Nature of the Service

3.1 Experimental Software

The Service is provided as experimental, pre-release software. It may contain bugs, errors, and security vulnerabilities. The network architecture, tokenomics, API endpoints, and all other aspects of the Service are subject to change without notice.

3.2 Decentralized Network

Inference requests are processed by independent third-party providers who operate their own hardware. We do not control, monitor, or guarantee the behavior of individual providers. The coordinator routes requests but does not execute inference.

3.3 No Guaranteed Availability

The Service may be unavailable, interrupted, or degraded at any time. We do not guarantee uptime, response times, model availability, or inference quality. Provider availability depends on individual operators who may go offline at any time.

4. Acceptable Use

You agree not to use the Service to:

  • Generate content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable under applicable law.
  • Generate, distribute, or facilitate the creation of child sexual abuse material (CSAM) or any content that exploits minors.
  • Generate content designed to deceive, defraud, or mislead others, including deepfakes, impersonation, or disinformation campaigns.
  • Develop, produce, or distribute malware, exploit code, or tools designed to attack computer systems.
  • Generate content related to the creation of weapons, explosives, or dangerous substances.
  • Attempt to circumvent, disable, or interfere with the anti-gaming or validation systems.
  • Submit fraudulent inference results, manipulate the emission schedule, or engage in Sybil attacks.
  • Use automated systems (bots, scrapers) to abuse the Service beyond normal API usage.
  • Reverse engineer, decompile, or attempt to extract source code from the coordinator software, except as permitted by applicable law.
  • Interfere with or disrupt the Service, the coordinator, or any provider's operations.

We reserve the right to suspend or terminate access for any user or provider who violates these Terms, without notice or liability.

5. User Accounts and Authentication

The Service does not require traditional accounts. Users authenticate via Ethereum wallet addresses (MetaMask) or shared demo keys. You are solely responsible for the security of your wallet, private keys, and session tokens. We cannot recover lost keys or tokens.

6. xRAM Token

6.1 Utility Token

xRAM is a utility token used solely to facilitate payments and rewards within the RAM Aggregator network. It is not a security, investment contract, or financial instrument. See our Token Disclaimer for important additional information.

6.2 No Refunds

xRAM token deposits used for inference are non-refundable once consumed. Unused deposit balances may be withdrawn via the escrow smart contract, subject to on-chain transaction fees (gas). We are not responsible for tokens lost due to smart contract interactions, network failures, or user error.

6.3 No Guaranteed Value

xRAM tokens have no guaranteed monetary value. The price, liquidity, and utility of xRAM may fluctuate or decline to zero. We make no representations about the future value of xRAM.

7. Provider Terms

7.1 Provider Responsibilities

As a provider, you agree to: run legitimate inference using the specified models, return honest and complete results, maintain reasonable uptime and responsiveness, not tamper with or manipulate inference outputs, and comply with all applicable laws in your jurisdiction.

7.2 Provider Data Handling

Providers receive user prompts in order to execute inference. Providers must not log, store, transmit, or retain user prompts or responses beyond what is necessary for the immediate inference operation. Providers must not attempt to identify, track, or profile users.

7.3 Reward Eligibility

Provider rewards are subject to the anti-gaming validation system. We reserve the right to withhold rewards for inference results that fail validation checks, and to impose reputation penalties or bans for repeated violations.

8. Privacy and Data

Our collection and use of data is described in our Privacy Policy. By using the Service, you acknowledge and agree to the data practices described therein.

When end-to-end (E2E) encryption is enabled, the coordinator cannot access the content of your prompts or responses. When E2E encryption is disabled, the coordinator may process prompt and response content for routing, validation, and billing purposes. 9. Intellectual Property

9.1 Your Content

You retain all rights to the prompts you submit and the responses you receive. We do not claim ownership of your content. We do not use your prompts or responses to train, fine-tune, or improve any AI models.

9.2 Our Content

The RAM Aggregator name, logo, website design, documentation, coordinator software, and provider application are the property of the RAM Aggregator team or its licensors. You may not use our trademarks without prior written permission.

9.3 Open Source Models

The AI models available on the network are open-source models published by third parties (Meta, Mistral, Alibaba, DeepSeek, etc.) under their respective licenses. Your use of model outputs is subject to the applicable model license. We do not claim ownership of or responsibility for model outputs.

10. Disclaimers

Important — Please Read THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED.

10.1 No Warranty

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, WE EXPRESSLY DISCLAIM ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF VIRUSES OR OTHER HARMFUL COMPONENTS.

10.2 AI Output Disclaimer

AI model outputs may be inaccurate, incomplete, biased, offensive, or harmful. You are solely responsible for evaluating and using any AI-generated content. Do not rely on AI outputs for medical, legal, financial, or safety-critical decisions. We are not responsible for any actions taken based on AI-generated content.

10.3 Third-Party Providers

We do not control or vet individual providers on the network. Providers are independent operators. We make no representations about the identity, reliability, security practices, or legal compliance of any provider. You use the Service at your own risk.

10.4 Blockchain and Smart Contract Risks

The xRAM token operates on the Base blockchain. Smart contracts may contain bugs or vulnerabilities. Blockchain transactions are irreversible. We are not responsible for losses arising from smart contract exploits, blockchain network failures, gas fee fluctuations, or any other blockchain-related risks.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE RAM AGGREGATOR TEAM, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, DATA, TOKENS, CRYPTOCURRENCY, OR OTHER INTANGIBLE LOSSES, REGARDLESS OF WHETHER WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNT OF xRAM TOKENS YOU DEPOSITED IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED US DOLLARS ($100).

SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OR LIMITATION OF CERTAIN DAMAGES. IN SUCH JURISDICTIONS, OUR LIABILITY SHALL BE LIMITED TO THE MAXIMUM EXTENT PERMITTED BY LAW.

12. Indemnification

You agree to indemnify, defend, and hold harmless the RAM Aggregator team and its affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any applicable law, (d) content you submit to the Service, or (e) your provider operations and the data you process.

13. Modifications

We may modify these Terms at any time. Material changes will be posted on this page with an updated "Last Updated" date. Your continued use of the Service after changes are posted constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

14. Termination

We may suspend or terminate your access to the Service at any time, for any reason, without prior notice or liability. Upon termination, your right to use the Service ceases immediately. Sections 6 (xRAM Token), 9 (IP), 10 (Disclaimers), 11 (Limitation of Liability), 12 (Indemnification), and 15 (Governing Law) survive termination.

15. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved through binding arbitration under the rules of the American Arbitration Association, conducted in English. You waive any right to participate in a class action lawsuit or class-wide arbitration.

16. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

17. Entire Agreement

These Terms, together with the Privacy Policy and Token Disclaimer, constitute the entire agreement between you and the RAM Aggregator team regarding the Service and supersede all prior agreements.
